Acción Diferida Para Llegadas Infantiles
What is DACA?
On June 15, 2012, President Obama announced a new policy called Deferred Action for Childhood Arrivals (DACA). DACA is not the DREAM Act itself, so it is not a new law that provides a path to permanent residency or citizenship.
DACA is meant to help those immigrants with undocumented status who arrived to the United States as children and meet other criteria (below). For successful applicants, it provides deferred action status, which is not residency, but which can prevent deportation by placing those with deferred action status at the bottom of the deportation list.
People who demonstrate that they meet the requirements (below) may file a DACA application requesting deferred action. The deferred action status lasts two years and may be renewed. Additionally, successful DACA applicants may be eligible to receive employment authorization and a driver’s license.
Que es DACA?
El día 15 de Junio del 2012, el Presidente Obama anunció una nueva norma de su administración, llamada Acción Diferida Para Llegadas Infantíles (DACA). Esta norma no és el DREAM Act, asi que no és una ley que confiere un camino ni a la residencia o a la ciudadanía.
DACA esta hecha para ayudar a esos inmigrantes con estado indocumentado quienes llegaron a los Estados Unidos de niños y satisfacen otros requerimientos (que siguen abajo). Para solicitantes exitosos, DACA provee un estado de acción diferida, que no és la residencia, pero que si puede prevenir la deportación a través de ponerle al solicitante al final de la lista de personas sujetas a la deportación.
Gente que pueda demostrar que satisfacen los requerimientos (que siguen abajo) puede someter una solicitación pidiendo acción diferida. Este estado dura dos años, y podrá ser renovada, según como sigue la norma a día de hoy. Solicitantes que tengan éxito con su solicitúd de DACA también puede que sean elegibles para obtener un permiso de trabajo y un carnet para conducir.
DACA’s Basic Requirements
- You were under the age of 31 as of June 15, 2012;
- You came to the United States before reaching your 16th birthday;
- You have continuously resided in the United States since June 15, 2007, up to the present time;
- You were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action;
- You entered without inspection before June 15, 2012, or your lawful immigration status expired as of June 15, 2012;
- You are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a General Education Development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and;
- You have not been convicted of a felony, significant misdemeanor, three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.
Los Requerimientos Básicos de DACA
- Tenía menos de 31 años el día 15 de Junio del 2012;
- Vino a los Estados Unidos antes de cumplir los 16 años;
- Ha vivido contínuamente en los Estados Unidos desde el 15 de Junio del 2007 hasta el tiempo presente;
- Estuvo físicamente presente en los Estados Unidos el día 15 de Junio del 2012 y también al tiempo de mandar la solicitación para Acción Diferida;
- Entro sin ser inspectado por Inmigración antes del 15 de Junio del 2012, o su estado legal migratorio se venció antes del 15 de Junio del 2012;
- Esta hoy en día en la escuela, o se ha graduado o ha obtenido una certificación de terminar el instituto (high school), o ha obtenido una certificación G.E.D., o ha sido honrablemente despedido de las fuerzas armadas de los Estados Unidos; y;
- No ha sido condenado de un delito (felony), ni de una falta (misdemeanor) significante, ni de tres o más faltas, ni presenta una amenaza a la seguridad nacional o seguridad pública de los Estados Unidos.
DACA Clinics Across Texas
TCRP is partnering with community organizations in Austin, Houston, and Dallas in the coming months to provide free legal help with DACA application preparation to eligible applicants. Additionally, TCRP will be organizing clinics in South Texas (near McAllen), the Tyler area, and the Odessa area to do the same.
Austin:
- The University of Texas School of Law is running free DACA clinics monthly until December. For more information, please call the Immigration Clinic at the law school at 512-232-1292. Priority will be given to high school students.
- The University Leadership Initiative is also running free DACA clinics throughout the fall semester. Please call 512-703-0228. These clinics are for university students.
The following non-profit organizations are providing DACA legal services at low-cost.
